Thursday, September 2nd, 2010I was in a car accident last week. It was my fault. I rear-ended a man in stop and go traffic going approximately 20mph.
Neither one of us wanted to go through insurance, so I said I would try to pay for the damages to his car out of pocket. (He was driving an suv suzuki).
There was a baby in the back seat who appeared to be fine, as did the man. The only damages were to his rear bumper and my front end.
He called me today (a week later) and told me it would be $840 to fix his bumper. I agreed to pay him, but then he said he also expects me to pay $600 for his medical bills.
An hour after the accident he said the baby started to cry so he decided to take his baby and himself to the ER to make sure they were ok.
He told me the doctor said they were fine, and the baby was probably just crying because he was hungry.
Am I responsible to pay his medical bills?!?! I don’t think so, because it’s not like he went to the hospital at the scene of the accident.
I’m not really sure what to do. I’m a student and I’m broke.
Also, it’s been a week… is he still allowed to claim anything on insurance if I don’t pay him?

Small Claims Court- Will insurance pay for my car accident?
Saturday, August 28th, 2010I’m being sued for my car accident and the Plaintiff wants $7,500 which is way too much, but anyway, I just want to know, if I lose the case, will my Insurance company pay him or will it have to come out of my pocket? I was insured when the accident happened. Also, the plaintiff claims that he contacted me prior to filing a court date but he never did contact me……can I use that against him? I just don’t feel that he deserves that much money. Supposedly his medical bills are $900.00 and car damage is $500….so where does the $7,500 come from? Anyway, I’d appreciate any advice on what I should do. Thank you.
Well, I called my insurance company and was told that he never got paid because they believed that I wasn’t at fault….will they still be paying him? Technically it’s the insurance company’s responsibility to take care of this court stuff because they didn’t pay him :/
btw, the accident was my fault….
oh, and I did report the accident once it happened. That was all taken care of.

Both of these instances are worrying, and even more so, if you or someone else in your vehicle was injured and the uninsured driver was at fault for the accident.
How can you make an accident claim if the other driver is not insured or drives off from the scene? Fortunately, in the UK there is an organisation that can help in these worrying circumstances.
The Motor Insurers Bureau (MIB) was established in 1946 to “compensate the victims of negligent uninsured and untraced motorists “. The MIB is funded by all Motor Insurers in the UK. So all legitimate drivers that pay insurance actually fund the MIB through their premium payments.
So How Does it Work?
First, you need to contact your own insurance company and let them know the circumstances of the accident.
Next set-up a meeting with your local personal injury lawyer / solicitor to make an arrangement for legal expenses insurance to help protect you against legal costs.
Claims can be submitted directly to MIB by the claimant themselves or by a personal injury lawyer / solicitor or by an appointed representative.
You still need to produce evidence that the other uninsured driver was at fault. So start collecting all documentation and evidence to prove that the uninsured driver was at fault for the accident. Please be aware that the MIB is however restricted in compensation payments and has a capped upper limit.

If you cannot trace the driver then still contact your own insurers and let them know the circumstances. You have up to 3 years to make a personal injury claim against an untraceable driver / vehicle.
